Martinique Contest Rules

« Food Trip To Martinique »  OFFICIAL CONTEST RULES


  1. PLACE AND TIMEFRAME


1.1 “Food Trip to Martinique” Contest (later referred to as “the Contest”) is sponsored by Food Trip To... (later referred to as “the Sponsor”), begins at 12:00 PM ET on August 15, 2017, and closes at 1:00 PM ET on October 22, 2017 (later referred to as “the Contest Period”).

  1. ELIGIBILITY


2.1 The Contest is open only to Canadian residents, having reached the age of majority at time of participation.

2.2 Employees of the Sponsors and of its partners, affiliates, promotion agencies, representatives and agents and parties involved in the development, production and distribution of material related to this Contest, and any person which whom such persons resides and any member of his or her immediate family are not eligible to participate in the Contest. For the purposes of these rules (“Rules”), “immediate family” shall include father, mother, brother(s), sister(s), children, husband, wife or partner of such person, whether or not they reside in the same household.

  1. PARTICIPATION


3.1 There is no purchase necessary to enter the Contest. The Participant may either purchase a Food Trip To Martinique box (later referred to as “the Participating Product”) or send a Letter (later referred to as “the Letter”) to the Sponsor to enter the Contest. Both ways, a Participant needs to obtain a participating card (later referred to as “the Participation Card”) on which appears a unique alphanumerical code.


3.2 In the case of a participation with purchase, the Participant must first purchase a Participating Product: the Food Trip To Martinique box sold through the foodtripto.com website. Each box contains a Participation Card. The Participant then has to preciously hold on to this Participation Card until the draw that will take place at the end of the Contest Period.



3.3 A Participant may also enter the Contest without purchase by mail by sending a handwritten Letter to the following address: Food Trip To Martinique Contest, Food Trip To..., 160 St-Viateur Est, Suite 710, Montréal (Québec), H2T 1A8. The Letter must be of at least fifty (50) words and describe why the participant would like to travel to Martinique. The Letter must also include the Participant’s first and last name, email address and province of residence. The Participant must include a stamped envelope with his/her return address. The Participant must send the Letter and the envelope by regular prepaid mail. In order to be eligible, the Letter must be received by October, 8, 2017 at 23:59 ET. The Sponsor will then send, by return mail, a Participation Card. The Participant then has to hold on to this Participation Card until the draw that will take place at the end of the Contest Period.


3.4 Online and print advertising will be used to promote the Contest during the Contest Period.

  1. PRIZES

4.1 One (1) prize only will be awarded during this Contest, consisting of a trip to Martinique (later referred to as “the Prize”). The prize will be given to the Winner as a letter inviting him or her to communicate with the Martinique Tourism Authority. That letter is valid for one year (1) starting from the moment it is issued and it is the Winner’s responsibility to get his bookings from the Martinique Tourism Office.


4.2 The Prize includes:

  • 2 (two) round trip economy flight tickets from Montreal to Fort-de-France, courtesy of Air Canada;
  • 7 (seven) nights at hotel Karibea in a standard room (double occupancy, breakfast included), courtesy of Martinique Tourism Office.

The Prize does not include:

  • transfers;
  • meals other than the breakfasts provided by the hotel.

Flight and hotel bookings are subject to availability, other restrictions apply.

 

4.3 The Prize Winner may choose one (1) guest (later referred to as “the Guest”) at his or her discretion. The Guest must have reached the age or majority in his province of residence.The Prize Winner and his or her Guest must travel together.

 

4.4 The Guest acknowledges and confirm that he or she agrees with these Contest rules and understand that the Sponsor and other organizations involved in the Contest as well as their respective employees are in no way liable for any injury, loss, misfortune or accident related to the Contest or the Prize.


4.5 Any trip taken as the Prize is done so entirely at the Winner and his or her Guest’s own risks.

 

4.6 The approximate Prize value is two thousand and eight hundreds Canadian dollars (CAD 2,800).





  1. PRIZE DISTRIBUTION


5.1 A draw will take place on October 22, 2017 at 1:00 PM ET, among all the alphanumerical codes listed on the Participation Cards.


5.2 The winning alphanumerical code will be announced on the Sponsor’s Website and Facebook page. An email will also be sent to the people having purchased a Food Trip To Martinique box through the foodtripto.com website and having authorized the Sponsor to send them email communications.


5.3 To claim his or her prize, the owner of the Participation Card listing the winning alphanumerical code (later referred to as “the Winner”) must get in touch with the Sponsor within 7 business days of the winning alphanumerical code announcement by email at contact@foodtripto.com, phone at +1 514 243-9256, or by registered mail at the following address: Food Trip To Martinique Contest, Food Trip To..., 160 St-Viateur Est, Suite 710, Montréal (Québec), H2T 1A8. Should the Winner fail to get in touch with the Sponsor in the given timeframe, he will loose his Prize.


5.4 To receive his or her Prize, the Winner must:

5.4.1 Upon request, provide a document showing proof of identity, age and residence.


5.4.2 Provide proof that he his the rightful owner of the Participation Card listing the winning alphanumerical code.


5.4.3 Sign a declaration and release form indicating he has read and agreed to comply with the Contest Rules, accept the Prize as is, authorize the Sponsor to use, broadcast, publish and distribute his full name, place of residence, photos, images, declarations and voice, in any promotion, advertising, newsletter, entertainment or informative content without any additional compensation; release the Sponsor form any responsibility regarding her participation in the Contest, his acceptance and use of the Prize. On this form, the participant will also be required to answer correctly a mathematical question. The Sponsor will send the declaration and release form by email and the participant must complete and return it within seven (7) business days after reception.


5.5 Should the Winner fail to comply with the Contest Rules (including conditions listed in article 6.1), or if he refuses the Prize, he will be disqualified and will be no longer eligible to claim the Prize. This participant will be considered to have forfeited the Prize and the Sponsor will no longer be required to distribute the Prize. Another Winner will be selected.

5.6 It is the Participant’s responsibility to inquire about the winning alphanumerical code by contacting the Sponsor. The Sponsor cannot be held responsible should the winning Participation Card owner not see the winning number announcement or fail to contact the Sponsor within the given seven (7) business day period. This participant will be considered to have forfeited the Prize.


5.7 The chance to win the Grand Prize depends on the number of Participation Cards distributed during the Contest Period through the Food Trip to Martinique boxes sold as well as through Participations requested through a Letter (see section 3.3).


  1. GENERAL CONDITIONS


6.1 By accepting a prize, participants acknowledge having read the Contest Rules and agree to be bound by them.

6.2 All decisions made by the Sponsor, and/or any other independent organization overseeing the Contest (pertaining to all aspects of the Contest, including but not limited to participants’ eligibility) are final and binding for all participants in all circumstances of this Contest. However, any litigation respecting the conduct or organization of a publicity Contest may be submitted to the Régie des alcools, des courses et des jeux (later referred to as “the Régie”) for a ruling. Any litigation regarding the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

6.3 The Winner’s Participation Card is subject to verification by the Sponsor. Participation Cards that are illegible, fraudulent, damaged or that do not entirely respect the Contest Rules in any way will be rejected by the Sponsor, cancelling the entry and therefore the chance to win a Prize.

6.4 The Sponsor reserves the right at its sole discretion and without notice to void an entrant’s participation in case the entry has been made via methods that are fraudulent, unfair to the other participants or not in compliance with the Contest Rules. Communications to the concerned authorities may be made regarding such participants.


6.5 By entering the Contest, participants agree to release the Sponsor, their agencies as well as each of their respective directors, officers, employees, parent companies, subsidiaries, affiliates, suppliers, sponsors and agents from any and all liability for any injuries, loss, damage or claim of any kind resulting from their participation or attempt to participate in the Contest, acceptance, possession, use or misuse of the Prize. The Sponsor, their agencies, as well as each of their respective directors, officers, employees, parent companies, subsidiaries, affiliates, suppliers, sponsors and agents cannot be held accountable in whole or part, directly or indirectly for:


6.5.1 Printing, typography or reproduction errors in materials linked to the Contest;


6.5.2 Any fees incurred by a Participant to enter the Contest;


6.5.3 Any other incident likely to hinder someone from participating in the Contest, including the following: lost, erased, corrupted, wrongly dispatched, incomplete, illegible, incorrect communications; problems linked to Postes Canada or any other transport or mailing contractor, technical or computer problems linked to the Internet, software, networks, connectivity, transmission processes, printing, inserting of any kind or any combination of those factors, no matter the network, Internet service provider or computer.


6.6 The Sponsor cannot guarantee that the access to the foodtripto.com website will be uninterrupted for any reason during the Contest Period.


6.7 The Sponsor reserves the right, subject to the Régie’s approval, to cancel, terminate, modify or suspend the Contest in whole or part in the event that human intervention or any other event would modify or impact the administration, security, fairness, integrity, or proper conduct of the Contest (i.e., fraud, technical failures or any other cause beyond the Sponsor’s control impacting the Food Trip To Martinique boxes).


6.8 Prizes must be accepted as described in the Contest Rules and can neither be redistributed nor sold to another person nor replaced with another prize or exchanged in whole or part for money except in the case described in the next paragraph.


6.9 Should it be impossible, more difficult or more expensive to award a prize, in whole or part as described in the Contest Rules, the Sponsor reserves the right at its sole discretion, to replace the Prize (or a part of the Prize) with an alternative equivalent in type and value as indicated in article 4.1 of the Contest Rules.


6.10 The Sponsor, their parent companies, subsidiaries, affiliates, suppliers, sponsors and agents are, under no circumstances, bound to award more prizes or use means other than those that are in compliance with what is described in the Contest Rules.


6.11 Contest declaration forms are the sole property of the Sponsor and will not be returned to participants in any case.


6.12 The Contest Rules are available online at foodtripto.com during the Contest Period. The Sponsor reserves the right to modify the Contest Rules at any time without affecting the content of the above-mentioned conditions.


6.13 No communication will be exchanged except in the situations described in the Contest Rules or at the Sponsor’s discretion.


6.14 Any deliberate attempt to damage the Participating Cards or compromise the proper conduct of the Contest is a clear violation of civil and criminal laws. Should such an event happen, the Sponsor reserves the right to pursue legal action against the offending individual.


6.15 By entering the Contest, participants agree to the use and disclosure of their personal information by the Sponsor and their authorized agents for the purpose of administering the Contest. If the participants agree during their participation, the Sponsor will be permitted to provide, by mail or email, information pertaining to the Sponsor’s products and promotions. The Sponsor agrees not to sell, share or disclose participants’ personal information to the benefit of a third-party, outside reasonable use for the purpose of the Contest and within the law.


6.16 Any request regarding the personal information retained by the Sponsor must be addressed to: Food Trip To..., 160 St-Viateur Est, Suite 710, Montréal (Québec), H2T 1A8.


6.17 Should there be discrepancies between the conditions of the Contest Rules and reproductions in Contest communication pieces, including but not limited to the entry form, point of sale materials, television, print or online advertising, conditions listed in these Contest Rules will prevail and will be used as reference.


6.18 Any intellectual property, including but not limited to trademarks, commercial brands, logos, designs, promotional pieces, Webpages, source codes, drawings, illustrations, taglines and representations are the property of the Sponsor and/or its affiliated companies or official partners. All rights reserved. Any unauthorized reproduction or use of any design protected by intellectual property or author’s rights is strictly prohibited without express written authorization from its owner.
